Katie Holmes has filed for divorce from Tom Cruise after five years of marriage and is seeking sole custody of their six-year-old daughter Suri.
The divorce papers were filed in New York City under “irreconcilable differences” which is allegedly due to Holmes not agreeing with Cruise when it came to allowing Suri to become active in his Scientology religion since she has reached the participation age according to the church’s rule.
Cruise was reportedly “blindsided” by the divorce and asking the media to respect their privacy as they try to work things out. There is no word on how he discovered Holmes filed for divorce. Cruise and Holmes have not been seen together in public for quite some time; however, Cruise has been in Iceland filming Oblivion.
There are reports that the pair does have a prenup which was signed in California, but Holmes is still seeking child support along with a division of property. The prenup is rumored to have a contract which will pay Holmes a certain amount in case of a divorce depending on how many years the pair was married. According to Forbes, Cruise made $75 million in the past year and an estimated $200 million over the past five years.
There are speculations the divorce papers were filed in New York due to the state’s law to not allow joint custody between parents. New York courts prefer to give sole custody to one parent based on what is best for the child. Since the marriage license and prenup was created in California, some of the judgment (if the Cruise and Holmes go through with the divorce) may bounce back to California law.
